A man who flew from Brisbane to Charlotte on an Epstein flight on February 11 has been charged with four counts of fraud, fraud by deception and conspiracy to commit fraud.
Ellen Alan Epstein, 46, who lives in Melbourne’s CBD, is charged with six counts of conspiracy to mislead and two counts of breach of trust.
He is due to appear in Magistrates Court on February 19.
Mr Epstein, who had been a passenger on the same flight, will appear in Melbourne Magistrates’ Court on Friday.
He was not present when Magistrate Michelle Wilson handed down her sentence.
He will remain in custody until sentencing.
Flight radar shows the aircraft departed from Brisbane on February 10 at 10:00am.
On February 12, the same day Epstein was due to arrive at the airport, a flight from Melbourne to Charlotte was cancelled.
The flight was supposed to fly to Charlotte from Melbourne’s Brisbane Airport.
Ellens flight from Brisbane landed at Melbourne’s Macquarie Airport at 4:15pm, but at 7:45pm it diverted to Charlotte’s Brunswick Airport.
It was scheduled to return to Brisbane on Friday but the airline was forced to reroute it due to the weather.
Ms Wilson said Epstein flew from Melbourne and was in Charlotte on the night of the flight.
“There was a concern about his mental health and there was also concern about the flight’s safety,” she said.
A spokeswoman for the airline said Epstein did not arrive at Charlotte Airport on the day of the alleged fraud and was not a passenger in the aircraft.
She said there were concerns Epstein had not received the required medical treatment for depression, which has also been ruled out.

Ms Kelly said she did not know if Epstein had been able to pay for the flight out of pocket or if he was able to make other payments.
